These General Terms and Conditions of Sale (hereinafter "GTC") govern all services offered by ÔME HOUSEKEEPING to its clients, whether individuals or professionals (real estate agencies, concierge services, short-term rental managers, and any other legal or natural person acting as part of their professional activity).
​Any order for services implies full and unconditional acceptance of these GTC, which prevail over any other client document. ÔME HOUSEKEEPING reserves the right to modify its GTC at any time; the applicable GTC are those in effect on the date of the order.

Article 2 - Purpose and Scope

Article 3 - Services Offered

​ÔME HOUSEKEEPING offers the following services, performed at the client's home or on the entrusted property, in the Basque Country and southern Landes areas:

Essential Package - Regular home maintenance (routine cleaning, dusting, surface cleaning, vacuuming, floor washing). Intended for individuals under the Personal Services framework.

Premium Package - Thorough home cleaning (deep spring cleaning, complete room-by-room cleaning including areas not usually treated during routine maintenance). Available to individuals and professionals.

LCD Package (Short-Term Rentals) - Turnover cleaning between guests for Airbnb owners and similar platforms, including complete cleaning, inspection of the premises, and preparation of the property for the arrival of the next guests. Intended for both individual property owners and professional managers/concierge services.

End-of-Lease Cleaning / Restoration - Complete and thorough cleaning of the property upon return of keys, designed to meet the requirements for move-out inspections. Available for both individuals and professionals (real estate agencies, property managers).

Ironing Service - Folding and ironing of household linens and clothing. Intended for individuals under the Personal Services framework, as well as professionals (rental linens, hotel linens).

Article 4 - Service Area

ÔME HOUSEKEEPING operates within a 25-kilometer radius around Bayonne, covering in particular the municipalities of the Basque Country and southern Landes.
​Any intervention outside this area will be evaluated on a case-by-case basis and may result in travel fees.

Article 5 - Quotation and Contract Formation

All services are subject to a prior, free, and non-binding quote, established after a property visit or a phone/form exchange, depending on the nature of the service.
The quote specifies: the nature of the services, the estimated duration, the applicable hourly or flat rate, the planned date and time of intervention, and the payment terms.
The contract is formed under the dual condition of the client's signature (or electronic acceptance) of the quote and confirmation of the service by ÔME HOUSEKEEPING.
​No intervention is committed to without formal agreement.

Article 6 - Rates

Applicable rates are those indicated on the quote accepted by the client. They are expressed in euros, tax included.
As a sole proprietor (auto-entrepreneur), ÔME HOUSEKEEPING is not subject to VAT (article 293 B of the French General Tax Code).
For Individual Clients – Immediate Tax Credit Advance (URSSAF) – Under the Personal Services scheme, eligible individuals benefit from a 50% tax credit on the amount of eligible services. ÔME HOUSEKEEPING offers the Immediate Advance option, allowing this credit to be deducted directly at the time of payment, without waiting for the annual tax return. The client therefore only pays 50% of the actual service amount. This scheme applies only to services performed at the individual's home under the Personal Services framework.
For Professional Clients – Services performed on behalf of professionals (real estate agencies, concierge services, rental managers) do not fall under the Personal Services framework and are not eligible for the tax credit. Rates are those agreed upon in the quote, with no associated tax benefit.
​ÔME HOUSEKEEPING reserves the right to modify its rates at any time. New rates apply to services ordered after they take effect and do not affect quotes already accepted.

Article 7 - Payment Terms

Payment is due at the end of each service or according to the terms specified in the quote (monthly direct debit for subscriptions, deposit for certain one-time services).

Accepted payment methods: bank transfer, online payment by credit card via Stripe, cash (within legal limits).

For professional clients - A payment term may be agreed in writing in the quote, within a limit of 30 days from the invoice date, in accordance with Article L.441-10 of the French Commercial Code. In case of late payment, late fees apply at the legal rate in effect (minimum 3 times the legal interest rate).

For individual clients - In case of late payment, late fees at the legal rate in effect apply after a formal notice remains without effect.

Article 8 - Terms of Service Execution

Access to the property - The client agrees to allow access to the home or property at the agreed time, either by being present or by providing the necessary keys or access codes as agreed between the parties.

​Conditions of intervention - The property must be in a condition allowing the normal performance of the service (free access to the areas to be cleaned, running water and electricity available). In the event of conditions making the intervention impossible or dangerous, ÔME HOUSEKEEPING reserves the right to interrupt or refuse the service, which will nevertheless be invoiced up to the amount of the travel fee.

​Products and equipment - ÔME HOUSEKEEPING provides its own equipment and eco-friendly products. If the client wishes specific products to be used, they must inform ÔME HOUSEKEEPING in advance and provide them.

​Pets - The client must inform ÔME HOUSEKEEPING of the presence of pets. They must be secured during the intervention if their presence is likely to interfere with the service.

Article 9 - Cancellation and Rescheduling

​By individual clients - Any cancellation or rescheduling request must be communicated to ÔME HOUSEKEEPING at least 48 hours before the scheduled service, by email or phone. Beyond this deadline, the service will be charged at 50% of the planned amount. In case of absence without notice, the service will be fully charged.

By the professional client - Cancellation and rescheduling terms are those agreed in the quote or framework agreement. In the absence of any provision to the contrary, 48 hours' notice is required; in the event of late cancellation or absence, the service will be invoiced in full.

​By ÔME HOUSEKEEPING - In the event of an inability to perform the service (illness, force majeure), ÔME HOUSEKEEPING commits to informing the client as soon as possible and proposing a rescheduled date. No penalty applies in this case.

Article 10 - Subscriptions and Recurring Contracts

ÔME HOUSEKEEPING offers recurring subscription plans (weekly, biweekly, or monthly), available to both individuals and professionals.
​12-Month Annual Subscription - The client benefits from a 10% discount on all services in exchange for a firm 12-month commitment. In case of early termination before the 12-month term, the 10% discount granted on all services already performed since the beginning of the contract will be fully recovered and added to the final invoice issued. The corresponding amount is calculated based on the difference between the full rate and the reduced rate applied since the beginning of the contract.

Article 11 - Liability

ÔME HOUSEKEEPING is covered by Professional Liability Insurance for all of its interventions. In the event of damage caused by a proven fault during a service, the client must report it within 24 hours following the intervention by email with supporting photos.
ÔME HOUSEKEEPING's liability cannot be engaged for damages resulting from a pre-existing defect that was not reported (fragile coverings, faulty installations, furniture in poor condition), improper use of the property, or cases of force majeure.
ÔME HOUSEKEEPING cannot be held liable for the loss or theft of valuable items left accessible during interventions. All clients are advised to secure their valuable items before each intervention.

Article 12 - Discretion and Confidentiality

​ÔME HOUSEKEEPING staff are bound by an absolute duty of discretion regarding information and elements they may have access to during interventions. They undertake not to disclose any information relating to the private life of occupants, the organization of the property, or any confidential information brought to their knowledge, including in the context of services performed for professional clients.

Article 13 - Right of Withdrawal

Individual clients only - In accordance with Article L.221-18 of the French Consumer Code, individual clients have a period of 14 days from the conclusion of the contract to exercise their right of withdrawal, without having to justify their reasons.

However, if the client has expressly requested that the service begin before the expiry of this period, they acknowledge partially waiving their right of withdrawal for the part of the service already performed (Article L.221-25 of the French Consumer Code). They will then be liable for the amount corresponding to the service already provided.

Professional clients - The right of withdrawal provided for by the Consumer Code does not apply to contracts concluded between professionals. Cancellation terms are those set out in Article 9.

Article 14 - Mediation and Dispute Resolution

​For individual clients - In the event of a dispute, the client may use consumer mediation free of charge. ÔME HOUSEKEEPING has designated the following mediator:

​Mediation may be sought after attempting to resolve the dispute directly with ÔME HOUSEKEEPING.

For professional clients - In the event of a dispute between professionals, the parties undertake to seek an amicable solution before any legal action. Failing an amicable resolution within 30 days, the dispute will be brought before the competent courts of Bayonne.

Article 15 - Applicable Law

These General Terms and Conditions are governed by French law. Any dispute relating to their interpretation or execution shall be submitted to the competent French courts.

Article 16 - Miscellaneous Provisions

​If any clause of these General Terms and Conditions is declared null or inapplicable, the other clauses shall remain fully in effect. The fact that ÔME HOUSEKEEPING does not enforce a clause of the General Terms and Conditions does not constitute a waiver of that clause.
